Brasilia Echevarria and Suyid Loza Secure Significant Maritime Defense Victory
Horr, Skipp & Perez, P.A. is pleased to share that the trial team of Brasilia Echevarria and Suyid Loza, J.D. recently secured a significant victory on behalf of one of our cruise line clients, obtaining summary judgment on all counts in a maritime personal injury action involving an alleged slip-and-fall aboard a cruise ship.
In a detailed opinion, the Court granted both our Daubert motion challenging the plaintiff’s expert testimony and our motion for summary judgment.
Specifically, the Court excluded the plaintiff’s slip-resistance expert, finding that his testing of the flooring under wet conditions was irrelevant and potentially misleading where the evidence failed to establish that the floor was wet at the time of the incident, and excluded the plaintiff’s treating physician’s causation opinions, finding the methodology unreliable because the physician failed to consider alternative causes of the plaintiff’s injuries.
Summary judgment was granted on all three negligence claims, finding insufficient evidence of an unreasonably dangerous condition, actual or constructive notice, or the cruise line’s involvement in the allegedly negligent design.
This decision reinforces the principle that the mere occurrence of an accident does not establish negligence, speculation cannot substitute for evidence, and expert opinions must be supported by reliable methodologies grounded in the facts of the case.
Congratulations to Brasilia Echevarria and Suyid Loza, J.D. on this achievement!
