Defense Team Secures Key Summary Judgment Ruling for Cruise Line Client

Congratulations to the trial team of Marian L. Rivera, Esq. and Jake Ceballo, Esq. on securing a partial summary judgment on behalf of our cruise line client in a passenger personal injury action arising from an alleged slip and fall on a wet exterior deck. The Court agreed with the defense that the wet deck—caused by active rainfall at the time of the incident—constituted an open and obvious condition. Accordingly, the Court held that the cruise line had no duty to warn the passenger of the condition.
